Terms and conditions
The terms that apply when you order from LiteCraft. Written plainly, and in addition to your rights under the Australian Consumer Law.
1. About these terms
These terms and conditions govern your use of the LiteCraft website and any purchase of kayaks, stand up paddleboards, accessories or related services from LiteCraft Pty Ltd (ABN available on request), based on the Gold Coast, Queensland, Australia.
By accepting a quote, placing an order or making a payment, you agree to these terms. If you do not agree, please do not place an order.
2. Products and information
We take care to describe our products accurately. Composite craft are handmade, so minor variations in finish, weight, colour and layup are normal and are not defects.
Images, diagrams and specifications are indicative only. We may improve or change specifications without notice, provided the change does not materially reduce the performance of the craft you ordered.
3. Quotes, orders and acceptance
Submitting a website enquiry does not place an order. We will review your selected configuration and confirm availability, lead time, freight and final pricing before sending an invoice and EFT payment details.
A quote is an invitation to order and is valid for 30 days unless stated otherwise. Your order is only accepted once we confirm it in writing and receive the agreed payment.
We may decline or cancel an order where a product is unavailable, where pricing or product information was published in error, or where we reasonably suspect fraudulent activity. In that case we will refund any amount you have paid.
4. Prices and payment
All prices are shown in Australian dollars and include GST where applicable, unless stated otherwise. Prices exclude delivery, freight insurance and any import duties or taxes payable outside Australia.
Payment is made by electronic funds transfer (EFT) using the details provided by LiteCraft after your order has been reviewed and confirmed. Payment must clear before goods are dispatched or handed over.
5. Custom builds and payment
We will confirm the payment amount and timing for your custom build in writing before production begins. Because each craft is built to your configuration, payments may become non refundable once production begins, except where required by the Australian Consumer Law.
The full agreed amount must be paid before delivery or collection unless we agree otherwise in writing. If an amount remains unpaid 30 days after we notify you that your craft is ready, we may charge reasonable storage costs.
6. Lead times, delivery and risk
Lead times are estimates only. We will keep you informed of any change and will not be liable for delays caused by matters outside our reasonable control, including shipping, weather, supplier delays or material shortages.
Risk in the goods passes to you on delivery or collection. Title passes once payment has been received in full. Please inspect your goods on arrival and report any transit damage to us and to the carrier within 48 hours, with photographs.
7. Cancellations, returns and change of mind
Stocked accessories may be returned within 14 days of delivery if unused, in original condition and packaging. Return freight is at your cost and a restocking fee may apply. Contact us before returning anything.
Custom built or made to order craft cannot be returned for change of mind. This does not limit your rights where goods are faulty.
8. Warranty
LiteCraft craft carry a manufacturer's warranty against defects in materials and workmanship from the date of delivery. The warranty covers repair or replacement at our discretion and is not transferable unless we agree in writing.
The warranty does not cover normal wear, cosmetic marks, UV fading, impact or abrasion damage, damage from dragging, incorrect transport or tie down, unauthorised modification or repair, misuse, commercial hire use, or failure to follow our care instructions.
9. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies those rights. Our manufacturer's warranty applies in addition to them.
10. Safe use and assumption of risk
Paddling, offshore fishing and watercraft use involve inherent risks. You are responsible for your own safety, for wearing an approved lifejacket, for carrying required safety equipment, and for complying with maritime and fisheries regulations in your state or territory.
To the extent permitted by law, we are not liable for injury, loss or damage arising from your use of a craft.
11. Liability
To the extent permitted by law, our total liability in connection with any product or these terms is limited to the amount you paid for the relevant goods, and we are not liable for indirect or consequential loss, including loss of profit or loss of enjoyment.
12. Intellectual property
All content on this website, including the LiteCraft name, logos, designs, photography and text, is owned by or licensed to LiteCraft Pty Ltd and may not be reproduced without written permission.
13. Privacy
We collect personal information such as your name, contact details and order details so we can respond to enquiries, process orders and provide support. We handle it in accordance with the Privacy Act 1988 (Cth) and do not sell your information. You may request access to or correction of your information by contacting us.
14. Governing law and contact
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction. We may update these terms from time to time; the version published at the time of your order applies to that order.
